Information We Collect and Use

We collect and process personal information for our internal and Website-related purposes, and to provide services to our customers.

Contact submissions. When you use a contact form on the Websites, we collect personal information from you to evaluate and respond to your request, and we may also use the information to improve our Websites or other aspects of our services. For example, we may collect the following personal information from you:

• personal identifiers, such as your name, email address, and telephone number;
• professional or business-related information, such as your company name; and
• message content.

Email Subscriptions. When you subscribe to receive email messages from us, we collect personal identifiers (such as your name and email address) and any related details you submit through a Website. We use that information to send you email messages containing news and other updates relevant to our business. You may choose to opt-out of receiving marketing email messages from us as described in the email you receive.

Communications. We receive information through your communications with us by email, phone or physical mail, and we process this information to respond to you and in the normal course of our business operations. For example, we may receive the following personal information from you:

• personal identifiers, such as your name, email address, and telephone number;
• professional or business-related information, such as your job title and company name; and
• message content.

Business Contacts. We may receive your contact information, such as your personal identifiers (including your name, telephone number, and email address) and/or professional or business-related information (including your business address), through our online or offline interactions with you, such as when we work together on a project or discuss opportunities to work together. We may send you emails or call you with information about our business dealings, news, or marketing information to communicate with you for business purposes. Where applicable law requires consent for electronic communications to be sent to you for the purpose of encouraging participation in a commercial activity, we will not send you any such communications without your consent. Where applicable, we aim to respect your preferences concerning electronic marketing communications in a timely manner and in accordance with applicable law.

Job Applications. Job application information may be collected by us directly through a Website, in-person, or by email, or job application information may be collected on our behalf by our contracted third-party administrator(s) for applicant tracking purposes and by background check providers. These third-party administrators are permitted to process the information you provide only for purposes of providing services to us. We process the information to review your job application and for other employment-related purposes consistent with applicable law, including to contact you regarding your application and/or to contact you about other job openings that we believe may be of interest to you.

Surveys. We may receive your information when you participate in a survey. We use this information to conduct the survey and in the normal course of our business operations.

Social Media.  If you post information on our social media pages, we may use the information to respond to your post, to promote our business and services, and in the normal course of our business operations. We may collect personal identifiers, such as your social media username, and other personal characteristics that you have made publicly available on the social media website. Note that the third-party operators of social media websites also receive such information and your posts, and their use of your personal information is governed by their own privacy policies.

Partners. We may receive your information, such as your personal identifiers (including your name, phone number, and email address), contact information (address), and professional or business-related information (including your place of employment and job position) from our partners, such as when you ask one of our partners for a product brochure or for more information about our products and services. We use this information to provide the information and materials requested and send you email messages containing marketing information, news, and other updates relevant to our business. You may choose to opt-out of receiving marketing email messages from us as described in the email you receive.

Automatically Through the Websites. When you visit our Websites, we and our third-party partners, such as analytics providers including Google Analytics, collect information by automated means. Such means include the use of cookies, web beacons, web server logs, and other similar technologies.

We may use such technologies to collect personal identifiers (such as your IP address), information about your device (such as your browser characteristics, device IDs and characteristics, operating system version, and language preferences) and information concerning your usage of our Websites (including the link you used to reach a given webpage). We may use this information to determine how many users have visited particular webpages, viewed particular content, or opened messages or alerts, and we may also use such information to improve the performance of the Websites, to improve our marketing activities, and to enforce our website service terms, prevent malicious conduct, and for anti-fraud and security purposes.

In some cases, our third-party partners may process information collected by cookies and related technologies that we permit them to use on the Websites. With respect to any social network pages that we may use, please see the privacy policies and any cookie policies of the applicable social network providers as to their automated data collection practices.

Like many other website operators, we currently use Google Analytics to collect and process certain Website usage data so we can evaluate our Websites’ traffic. To learn more about Google Analytics and how to opt out, please visit https://tools.google.com/dlpage/gaoptout.

You may be able to change a web browser’s settings to block and delete cookies when you access the Websites through that web browser. However, if you do that, the Websites may not work properly; also, we will still receive basic information (such as last URL visited) when you navigate to the Websites. The Websites do not respond to browser do-not-track signals.

Information Disclosures

We may provide third parties with the personal information we collect (as described above) for our business and commercial purposes to assist us in providing products and services to you.

To Affiliates. We may share information, including personal information, with our affiliates in the JCM family of companies, and any successors thereto in the normal course of our business operations, for business purposes such as to communicate with you and to promote and provide our services. In this regard, personal information may be shared with one of our affiliates for use in providing a service to us.

To Provide, Protect, and Improve Our Websites and Services. We disclose personal information as necessary to operate our business, such as with third-party providers in connection with providing the Websites and other services to you. We also may access, preserve, and disclose information if we believe that such action is necessary in our judgment to comply with a legal obligation or to protect and defend our rights or property, or those of others. For example, we may provide information, including IP address information, to our service providers to protect the Websites, such as for fraud detection purposes.

To Comply with the Law and Legal Process. We may access, preserve, and disclose information concerning you if required to do so by law or if we believe that such action is necessary in our judgment to comply with a legal obligation.

Other Sharing. We may share information as described under “Information We Collect and Use” above and for other business purposes as otherwise explained in this Privacy Policy.

Sales, Mergers, and Acquisitions. In the event of a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another entity (whether by private sale, through operation of law, as part of a divestiture plan, or otherwise), we will provide personal information and transaction history associated with each such business unit to the persons and/or entities assuming control of such business unit or as otherwise necessary to complete the transaction as permitted by law or contract.

Protection of Personal Information

We strive to process your personal information securely, in accordance with this Privacy Policy, and in accordance with information security requirements imposed by applicable law. We cannot, however, be responsible for Internet communications that are inherently not completely secure.

Privacy Rights

Certain jurisdictions impose specific legal requirements and privacy rights with respect to personal information, and we will comply with restrictions and any requests you submit as required by applicable law. For example, you may have the right to review, correct, and delete personal information we have about you. Please note that, when you make a request, we may require that you provide information and follow procedures so that we can verify your identity (and the applicable jurisdiction). The verification steps we take may differ depending on your jurisdiction and the request. Where possible, we will attempt to match the information that you provide in your request to information we already have on file to verify your identity. If we are able to verify your request, we will process it. If we cannot verify your request, we may ask you for additional information to help us do so.

We will respond to your request within the time period required by applicable law. However, we may not always be able or required to comply with your request, in whole or in part, and we will notify you in that event.

Links to Unaffiliated Third-Party Websites

The Websites may contain links to unaffiliated third-party websites, and third-party websites may link to the Websites. This Privacy Policy does not apply to the practices of such other websites, and we are not responsible for the actions and privacy policies of the third parties that operate or interact with those websites.

No Use By Children

The Websites are not intended for use by children. In particular, if you are under the age of 16, you may not use our Websites. We do not knowingly collect, maintain, or use personal information from children under 16 years old. If we believe that any information has been posted by a child under the age of 16, we will promptly delete that information. Parents may contact us using the methods set forth below to request that information concerning their child be removed from the Websites.

Supplemental California Privacy Notice

This Supplemental California Privacy Notice section provides additional information pursuant to the California Consumer Privacy Act, as amended by the California Privacy Rights Act (the “CCPA”), applicable to California consumers whose personal information we collect as described in this Privacy Policy. Note that this Privacy Policy (including this Supplemental California Privacy Notice) does not apply to personal information that is generated, collected, or maintained about California residents in connection with their role as our employees.

A California consumer has the following rights: to request additional information about our data collection, use, disclosure, and sales practices in connection with the consumer’s personal information; to request the specific personal information collected about the consumer during the previous 12 months; to request the deletion of the personal information we have about the consumer; to request a restriction on certain processing of personal information; or to request correction of inaccurate information. In addition, a consumer may opt-out of the “selling” or “sharing” of personal information. A California consumer may not be discriminated against for exercising the consumer’s California privacy rights.

Under the CCPA, California consumers may use an authorized agent to make privacy rights requests. We require the authorized agent to provide us with proof of the California consumer’s written permission (for example, a power of attorney) that demonstrates authorization to submit a request for the California consumer. An authorized agent must follow the process described below to make a request, and we will also (a) require the authorized agent to verify the agent’s own identity and (b) confirm the agent’s authority with the California consumer about whom the request was made.

Our use of cookies and similar technologies may constitute a “sale” or may constitute sharing for behavioral advertising purposes under the CCPA. We do not sell or share personal information, as those terms are used under the CCPA, except as set forth in our cookie disclosures. Please see our Cookie Policy for information about the collection and use of personal information by third parties who process information collected by cookies and similar technologies used on the Websites.  We do not seek to collect any “sensitive personal information” (as defined in the CCPA).

We use the following criteria to determine the length of time for which we retain personal information subject to this privacy policy:

• the purposes for which the personal information is used, and the length of time for which such information is required to achieve those purposes, including for business operations, security purposes, and legal requirements;
• whether we are required to retain the category of personal information in order to: (i) comply with legal or contractual obligations; (ii) assert or defend against potential legal claims or as necessary to investigate theft, fraud, or other activities that are potentially (a) in violation of our policies and procedures applicable to you or (b) a violation of the law; (iii) ensure a secure online environment; and/or (iv) protect health and safety;

• the manner in which the personal information is maintained and flows through our systems and how best to manage the lifecycle of such information in light of the volume and complexity of the systems in our infrastructure and the need to maintain high integrity and availability within our systems.

In addition, we delete personal information if a California consumer appropriately invokes the right to delete as to such personal information and no exception applies.
